Mamo TCV Associate to Compete in the Prestigious René Cassin Concours

Dr Mark Soler, an associate at Mamo TCV and current student at the College of Europe in Bruges, will be taking part in next year's European human rights moot court competition in honour of the French jurist René Cassin. Cassin served as President of the European Court of Human Rights, as vice-president of the French Conseil d'Etat and member of the French Conseil constitutionnel. It’s not always the driver’s fault!

In a judgment delivered on Friday 12th June 2020, the Civil Court, First Hall (the 'Court') found that a pedestrian was solely responsible for a traffic accident, as a result of which the same pedestrian had died. Mamo TCV recently delivered a seminar and workshop on dispute resolution to law students at the University of Malta in collaboration with the Junior Chamber of Advocates. The seminar was led by senior associates Michael Camilleri, Jonathan Abela Fiorentino & Matthew Cutajar from the firm's litigation practice group. Clear Indication that Appearing on Behalf of a Company is Required

The Court of Appeal (Superior) rejected the argument that the defendant intended to appear on behalf of a company (Sovereign Hotels Ltd) through the use of the letters 'c/o' (care of) in the case of Joinwell Ltd v. Ronald Azzopardi, decided on the 5th of October 2018. The Court indicated that it was a well-known fact that the letters 'c/o' were a mere indication of where correspondence should be directed and also observed that, unlike the defendant, the representative of Joinwell Ltd had clearly indicated that he was signing 'for and on behalf of Joinwell Ltd'.The defendant argued that he…
