Agreement Reached on Markets in Crypto-Assets Regulation (MiCA)

On 30 June 2022, the Council of the European Union (EU) announced1 that the Council presidency and the European Parliament reached a provisional agreement on the proposed markets in crypto-assets regulation (MiCA).  More details here.  The aim behind the proposed regulatory framework is to bring legal and regulatory certainty for crypto-asset operators across the EU.MiCA forms part of the Digital Finance Package proposed by the European Commission (EC) to fulfil its Digital Finance Strategy, which aims at developing a holistic approach across the EU to foster innovation, whilst ensuring financial stability and consumer protection. The Malta Digital Innovation Authority to issue a set of guidance notes aimed at assisting service providers and innovative technology arrangements applicants

The Malta Digital Innovation Authority ("MDIA") was established through Act XXXI of 2018 which has come into force on the 15th July 2018 and is now formally set up.The MDIA shall be responsible for recognising service providers, namely systems auditors and technical administrators as well as certifying innovative technology arrangements ("ITAS") as outlined in the Innovative Technology Arrangement and Services Act, Chapter 592 of the Laws of Malta.The MDIA will be issuing a set of guidance notes aimed at assisting services providers and innovative technology arrangement applicants when approaching the MDIA in relation to registration and certification.The guidelines to be…

Maltese Parliament has unanimously approved second reading of all three Cryptocurrency/Blockchain/DLT Bills

The Maltese Parliament has yesterday, Tuesday 26th June unanimously approved three Bills during a second reading in Parliament as announced by Parliamentary Secretary for Digital Innovation Hon. Silvio Schembri. This milestone development will make Malta one of the first countries to soon adopt a legal framework for ICO's, Exchanges and Innovative Technologies and position Malta as an attractive jurisdiction for investors and operators in the industry.
