Annual Leave Provisions in the Organisation of Working Time Regulations Amended Once Again

Legal Notice 59 of 2021 has amended the annual leave provisions in the Organisation of Working Time Regulations (S.L. 452.87). With effect from the 1st of January 2021, the days of annual leave have been reduced from 27 days to 24 days but employees shall be entitled to an additional day of annual leave in respect of public or national holidays falling on a Saturday, Sunday or weekly day of rest. COVID-19 Wage Supplement and Medical Benefit

The Maltese Government is providing businesses operating in certain sectors with a wage supplement for their employees. Applications for businesses to apply for the COVID wage supplement are now online. There are two lists of businesses with a corresponding benefit. COVID-19 Government Employment-Related Grants

The Maltese government has announced a number of employment related measures and grants in response to COVID-19. Applications are now available online for: 1. Parent Benefit: A parent who is employed in the private sector, with children under the age of 16 years, who cannot go to work after the 8 th March 2020 in order to take care of their children and cannot telework, are eligible for this benefit. Maltese Court of Appeal decides that Industrial Tribunal cannot award compensation for the way in which dismissal took place if the dismissal is found to be fair.

  In the case of Lucianne Lia vs Borg & Aquilina Ltd, the Maltese Industrial Tribunal (the 'Tribunal') had decided that whilst the dismissal had taken place for a justified reason at law, the employer had failed to properly warn the employee prior to said dismissal and for this reason, had awarded the employee the sum of €1,000.
