Mamo TCV Participates in Malta EU Presidency Conference on IPR Enforcement

On 2nd March 2017, an international conference on IPR enforcement was held at the Corinthia Hotel in St. George's Bay, St Julian's, Malta. The conference was organised by the Maltese Presidency of the EU Council, Malta Customs and the European Observatory on Infringements of Intellectual Property Rights (EUIPO). A number of prominent representatives from various institutions and bodies participated in the event (including the European Commission, UNIFAB, the EUIPO, INTA as well as the US attache' to the EU). Mamo TCV Advocates was represented by Dr. Claude Micallef-Grimaud from the firm's Intellectual Property (IP) Department who delivered a presentation on customs IPR enforcement by focusing on the applicable Maltese legal procedure. Dr. Micallef-Grimaud discussed various topics including the customs application for action contemplated by EU Regulation 608/2013, the procedure followed by Malta Customs when intercepting goods suspected of infringing intellectual property rights (IPRs) – both in the case of local consignments as well as in the case of 'goods in transit' – a brief look at the ex officio action, the procedure followed when judicial proceedings are commenced by the IP right-holders, as well as the post-judgment stage (when the detained goods confirmed as being counterfeit, pirated or infringing in any other manner contemplated by law are actually destroyed following a court order to that effect).
