In real estate, the team provides legal assistance to clients on issues arising from the purchase and sale of real estate located in Malta and Gozo. The typical legal services provided in this area include: 
  • representing clients in negotiations for real estate acquisitions;
  • drafting and assisting clients in the conclusion of the preliminary agreement for the transfer of the immovable property (that is, the promise of sale agreement or “konvenju”);
  • providing advice on real estate-related taxation issues;
  • registering the promise of sale agreement for tax purposes: according to Maltese law, the promise of sale agreement for the transfer of immovable property or any real right thereon shall not be valid unless notice thereof is given to the Commissioner of Inland Revenue within 21 days. Such notification shall be accompanied by a provisional duty on document payment equivalent to twenty per centum (20%) of the final duty payable. In the majority of cases, this provisional duty would amount to one per centum (1%) of the consideration paid for the property;
  • conducting searches at the Public Registry, where applicable the Land Registry and reviewing such searches in order to ascertain the vendors’ legal title to the property and whether there are any privileges or hypothecs burdening the property;
  • conducting the necessary arrangements leading to the conclusion of the final deed of sale, such as assisting clients in obtaining banking facilities; and
  • assistance on the final deed of sale.
