MALTA MARITIME LAW

Conscious of our geographical location, Mamo TCV holds strong links with all sectors of shipping and maritime law and the firm has specialised lawyers in these fields of law. We have the capacity to offer services in all aspects of shipping-related work including ship finance, litigation and admiralty.

SHIP REGISTRATION AND FINANCE

This is one of our traditional specialist areas. Our commitment and dedication has proved successful and banks, other financial institutions and ship-owners frequently consult us seeking the most effective and advantageous financing.

Our services in this area include:

flag and ship registration under Maltese flag and overseas and dealings with formalities related thereto;
bareboat charter registrations;
ship owning and ship management company incorporation;
marine mortgages and other form of securities;
discharging of mortgages;
ship sales and purchases;
ship finance;
chartering and leasing;
syndicated bank loans; and
generally advising financing institutions on security and mortgage enforcement matters as well as on other Maltese maritime law matters.

The firm represents large overseas companies mainly based in Germany and Turkey for whom vessels have been registered and are still being registered under the Malta Flag both as normal registrations and therefore hoisting the Malta Flag and bareboat charter registrations where the vessels are either bareboat chartered ‘in’ which gives them the right to fly the Malta Flag or bareboat chartered ‘out’ giving them the right to fly the Flag of a recognised jurisdiction.

COMMERCIAL YACHT REGISTRATION

The firm has been recently engaged in the registration of some of the most prestigious Yachts which have been built in recent years.

These yachts are being registered under the Commercial Yacht Registry and are subject to several Income Tax and VAT benefits.

VAT – LEASING STRUCTURES

Private yacht owners who are seeking to pay VAT on the value of their yacht are today seeking advice on the possibilities of implementing a leasing structure for the purposes of mitigating the VAT impact on such payment.

LITIGATION

We have also extensive experience of Admiralty claims (both wet and dry) and marine litigation and arbitration including arrests of vessels in Malta; salvage; loss or damage; towage; collision; enforcement of mortgages; cargo claims; bills of lading; contracts of affreightment; judicial sales and auctions of vessels; oil pollution.
